Escayp Travel – Booking Terms & Conditions

These Booking Terms & Conditions (“Terms”) govern all travel arrangements made through Escayp Travel (“we”, “us”, “our”), acting as an agent on behalf of third-party travel suppliers. By confirming a booking, the customer (“you”, “your”) agrees to be bound by these Terms.

1. Role of Escayp Travel

Escayp Travel acts solely as an intermediary between you and the travel supplier. We do not own or operate any travel services. Your contract for travel services is directly with the supplier, and their terms and conditions will apply in addition to ours.

We accept no liability for the acts or omissions of suppliers or for any services provided by them, except where such liability arises due to our own negligence.

2. Financial Protection

We only work with suppliers who provide full consumer financial protection under one or more of the following schemes:

  • ATOL (Air Travel Organiser’s Licence): For flight-inclusive packages, protection is provided under the ATOL scheme. You will receive an ATOL Certificate detailing your protection.

  • ABTA (Association of British Travel Agents): For non-flight packages, suppliers are ABTA members, offering financial protection and assistance in case of insolvency or disruption.

You are responsible for reviewing the protection offered and retaining all relevant documentation.

3. Booking Process

  • All bookings are subject to availability and confirmation by the supplier.

  • A deposit may be required to secure your booking. The balance must be paid by the date specified in your booking confirmation.

  • Prices are not guaranteed until your booking is confirmed. We reserve the right to amend prices due to supplier changes, currency fluctuations, or tax adjustments.

  • You will receive a booking confirmation and summary once your holiday is secured. It is your responsibility to check all details and notify us of any discrepancies immediately.

4. Quotations

  • All quotations are based on live availability and are accurate at the time of issue.

  • Quotations are subject to change until a booking is confirmed and a deposit is received.

  • We cannot guarantee quoted prices until the booking is secured. Delays in confirming may result in price changes or loss of availability.

5. Amendments and Cancellations

  • Amendments to confirmed bookings may incur additional charges, subject to supplier terms.

  • Cancellations must be submitted in writing. Cancellation charges will apply as per the supplier’s terms and may include loss of deposit or full payment.

  • We strongly recommend comprehensive travel insurance to cover cancellation, medical emergencies, and other unforeseen events.

6. Customer Responsibilities

  • You must ensure that all travel documents, including passports, visas, and insurance policies, are valid and appropriate for your destination.

  • Any special requests (e.g. dietary requirements, accessibility needs) must be communicated at the time of booking. While we will pass these on to the supplier, they cannot be guaranteed.

  • You must review all booking documentation and notify us of any errors or changes promptly.

  • You are responsible for complying with all health, safety, and entry requirements for your destination, including vaccinations, testing, and quarantine rules.

7. Escayp Travel Responsibilities

  • We will exercise reasonable care and skill in facilitating your booking and communicating with suppliers.

  • We are not liable for any loss, damage, delay, or injury arising from the acts or omissions of suppliers, except where caused by our own negligence.

  • We will assist in resolving disputes with suppliers where reasonably possible, but we do not guarantee outcomes.

8. Promotions and Discounts

  • Promotional offers are valid only during the stated promotional period and apply to new bookings made directly through Escayp Travel.

  • Discounts may be tiered based on booking value or destination and are applied at the time of confirmation.

  • Promotions cannot be combined with other offers unless explicitly stated.

  • Escayp Travel reserves the right to amend or withdraw promotions at any time without prior notice.

  • Each promotion will be accompanied by a specific disclaimer outlining eligibility, discount tiers, exclusions, and any applicable conditions.

9. Limitation of Liability

To the fullest extent permitted by law, Escayp Travel shall not be liable for:

  • Any indirect, incidental, or consequential loss or damage.

  • Any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, civil unrest, or supplier insolvency.

  • Any inaccuracies in supplier descriptions or representations.

  • Any loss arising from your failure to comply with health, safety, or entry requirements.

Our total liability shall not exceed the commission earned on the affected booking.

10. Force Majeure

We shall not be liable for any failure to perform, or delay in performing, any of our obligations under these Terms if such failure or delay results from events, circumstances, or causes beyond our reasonable control. This includes, but is not limited to, acts of God, war, terrorism, pandemics, government restrictions, or supplier insolvency.

11. Data Protection

We are committed to protecting your personal data. All information provided to us will be handled in accordance with applicable data protection laws and our Privacy Policy. By booking with us, you consent to the use of your data for the purpose of processing your travel arrangements and communicating with relevant suppliers.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
